Terms of Service

Welcome to Popcoinz. These Terms of Service ("Terms") govern your access to and use of the Popcoinz website, services, and applications (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

1. Acceptance of Terms

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy. These Terms constitute a legal agreement between you and Popcoinz.

2. Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this requirement. If you are accessing the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

3. Account Registration

To access certain features of the Platform, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Blockchain Transactions

The Platform utilizes blockchain technology to facilitate transactions between artists and fans. You acknowledge and agree that:

  • Blockchain transactions are irreversible and cannot be canceled once initiated.
  • You are solely responsible for maintaining the security of your digital wallet and private keys.
  • Popcoinz is not responsible for any loss of digital assets due to user error, forgotten passwords, phishing attacks, or security breaches of your digital wallet.
  • Blockchain transactions may be subject to network fees and processing times that are outside of our control.

5. Artist and Fan Relationships

The Platform enables direct relationships between artists and fans. As an artist, you agree to:

  • Provide accurate information about yourself and your music.
  • Fulfill any promises or obligations made to fans who support you through the Platform.
  • Maintain ownership and control of your intellectual property rights.

As a fan, you agree to:

  • Understand that supporting an artist through the Platform is not a guarantee of financial return.
  • Respect the intellectual property rights of artists.
  • Comply with the terms of any perks or experiences offered by artists.

6. Intellectual Property Rights

The Platform and its original content, features, and functionality are owned by Popcoinz and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Artists retain ownership of their intellectual property rights in their music and content. By uploading content to the Platform, artists grant Popcoinz a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display such content for the purpose of operating and promoting the Platform.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Violating any applicable laws, regulations, or third-party rights.
  • Using the Platform for any illegal purpose or to promote illegal activities.
  • Uploading or sharing content that infringes on intellectual property rights.
  • Impersonating another person or entity.
  • Interfering with or disrupting the Platform or servers or networks connected to the Platform.
  • Attempting to gain unauthorized access to any portion of the Platform.
  • Using the Platform to transmit any malware, viruses, or other malicious code.
  • Engaging in any activity that could disable, overburden, or impair the functioning of the Platform.

8. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.

9. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. POPCOINZ EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

POPCOINZ MAKES NO WARRANTY THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS, BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS, OR THAT DEFECTS WILL BE CORRECTED.

POPCOINZ DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION ON THE PLATFORM AND WILL NOT BE RESPONSIBLE FOR ANY LOSSES OR DAMAGES THAT MAY RESULT FROM THE USE OF SUCH INFORMATION.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POPCOINZ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Popcoinz and its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Platform, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Popcoinz is established, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Platform.
